By accessing or using the ACTQ Assessment platform ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms apply to all users including tenant administrators, team members, and assessment participants.
ACTQ Assessment provides a behavioral insight platform designed to help organizations understand team composition and improve workplace communication. The Platform offers self-assessments, observer assessments, individual behavioral profile reports, team composition maps, dyadic friction analysis, coaching scripts, and related tools. ACTQ is not a psychological assessment, medical evaluation, or diagnostic tool.
Organizations that sign up for the Platform ("tenants") are responsible for all activity within their account. Tenant administrators are responsible for ensuring that all users, including assessment participants, are informed of and consent to participation. You are responsible for maintaining the confidentiality of your login credentials.
You agree not to use the Platform to make employment decisions including hiring, termination, promotion, compensation, or disciplinary actions based on ACTQ results. ACTQ results are provided for coaching and communication support only. You agree not to use the Platform to harass, discriminate against, or otherwise harm any individual. You agree not to attempt to reverse engineer, scrape, or otherwise compromise the Platform's systems.
Assessment results and behavioral profiles belong to the individual who completed the assessment. Tenant administrators may access results for coaching and development purposes only. ACTQ Assessment will not sell, share, or use individual assessment data for any purpose other than providing the service. Tenant data is isolated and not accessible to other tenants.
The Platform offers a free tier allowing up to five assessments. Additional assessments require a paid subscription. ACTQ Assessment reserves the right to modify pricing and plan limits with reasonable notice. Access to certain features may be restricted based on subscription status.
The ACTQ framework, scoring methodology, report content, and all Platform materials are the intellectual property of ACTQ Assessment. You may not reproduce, distribute, or create derivative works from Platform content without express written permission.
The Platform is provided "as is" without warranties of any kind. ACTQ Assessment does not warrant that assessment results will be accurate, complete, or suitable for any particular purpose. Behavioral assessments describe tendencies and should not be used as the sole basis for any decision about an individual.
To the maximum extent permitted by law, ACTQ Assessment shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform. Our liability is limited to the amount paid by you in the twelve months preceding any claim.
We reserve the right to suspend or terminate accounts that violate these terms, misuse assessment data, or engage in prohibited conduct. You may cancel your account at any time. Upon termination, your data will be retained for 30 days before deletion.
We may update these terms from time to time. We will notify you of material changes via email or prominent notice in the Platform. Continued use of the Platform after changes constitutes acceptance of the updated terms.
